( +37 ) between Duty andfin, in the tine , as Circumfl'antiated it is not aE us humanas, a proper morali ad. But as Permi;ron is vainly nuu bred with proper ads ofLáw , it being but a Non impedire , a Negation of an ad ; fo Indifferency is as vainly annumerated to the products of a Law. For there needs no ad of Law to make a thing Indifferent that is Neither commanded nor forbidden. For inaance, it is Indifferent for me to wink, with my eyes ordinarily , becaufe it is not a Moral ad that a man is to ale his reafonabout, to bringevery twink of the eye to an Eled:on, or Retufai ; but we may leave it to Natural inflind. So in Dr. Burgeffes inftances, Whether I ft or fland at Sermon, (if I be equally difpofed, &ceteris pari. bus) is not a humane Moral ad : Whether Teat this Egg or that when they are equal is not a Moral ad : Nor do I pro.. perly Choofe, but take indierentiy without choice. And where there is no ufe of ckoice , the ad is not Moral, except in the Intention of the end, or in deliberating acceffes. ) Yet I grant that Moral ads may beexercifed about thefe objects: A fcrupu- lous mind maybe put to confider, whether this Gefare or that, this Egg or that is to be chofen but it mull conc'ude, that neither is to be chofen buteither to be taken Indiff rently. Which is but to fay that the Deliberation was a Moral act ; but the chopfang was not , for it was but a Taking, and not a Choof ing : And the Deliberation ftopt before it carne toa choi;e yea and purpofely avoided it, concluding that the object was not a Matter of choice, and the ad was not to be a Moral all: Morality hath but two Species ,Goodand Evil : and Indiferency is no third Species, but a Negation ofMorality : viz. of Goed or Evil. 14. Yet may one ,occident take off the Indif erency, and make the action good or Evil. And though the Governours themfelves fhould well weigh Accidents,` and prefer the chief, and lay no more upon them then they deferve: yet becaufe the Accidents are oft diflant, and unfeen, and the Ruler is the Judge of them, therefore the people fhould ordinarily obey when they fee them not themfelves. 4. 15. Objed. But in cafe the Genus is commanded by God, and the Species are equal may not the Gtvernour limit us to one of the two?'Efpecically in cafe the people are d.vided abo<t K k k 3 them,
